Start with the document and relief, not a guessed amount
Court fee is not one flat Gurgaon District Court charge. The amount can depend on the type of plaint, petition, appeal, application or copy request, the relief claimed, the valuation rules and any Haryana-specific amendment. Verify the applicable provision before payment or submission.
Which law governs court fees in Gurgaon District Court?
Gurgaon District Court is part of the Haryana subordinate judiciary. Court-fee liability therefore starts with the Court-Fees Act, 1870 as applicable in Haryana, including Haryana amendments, together with the procedural rules and filing requirements administered under the Punjab & Haryana High Court. The High Court's Rules and Orders, Volume IV, contains a dedicated chapter on court fees and stamps, covering remission or refund, the stamps used to denote fees, cancellation of court-fee stamps and related stamp-control matters.
This creates a two-layer verification problem for a filer: first identify the statutory fee rule for the document and relief, then verify the current filing/payment mechanism accepted for the Gurgaon court process.
Fixed fee, ad valorem fee and other charges are different
| Charge type | What usually determines it | Why the distinction matters |
|---|---|---|
| Ad valorem court fee | Value of the subject matter or relief under the applicable statutory provision and Haryana schedule/amendment | The payable amount can change with valuation rather than being a single fixed filing charge. |
| Fixed court fee | Particular document, petition, application or procedural category for which the schedule prescribes a fixed amount | Do not apply an ad valorem formula merely because the underlying dispute has monetary value. |
| Process fee | Separate rules concerning issue/service of court process | Process fee is not automatically the same thing as the court fee payable on the plaint or petition. |
| Copying/inspection charges | Separate rules for certified copies or judicial-record inspection | These are service-specific charges and should not be confused with the fee for instituting the case. |
The Haryana amendments reproduced in the official India Code compilation modify provisions and schedules of the Court-Fees Act for the State. That is why an amount taken from another State, another court or a generic online article should not be assumed to apply in Gurugram.
Why valuation is the first major decision point
For many civil filings, fee liability cannot be separated from valuation. A money claim, possession claim, declaratory relief, injunction, appeal or other proceeding may engage a different statutory method. Haryana amendments also affect how certain property-related claims are valued for court-fee purposes.
A useful filing sequence is therefore:
- Identify the exact relief or combination of reliefs claimed.
- Identify the statutory provision governing fee computation for that category.
- Determine the value relevant to court fee, which may or may not be identical to the value used for another procedural purpose.
- Apply the Haryana schedule/amendment in force.
- Verify whether the Gurgaon filing system expects electronic payment, court-fee stamp treatment or another approved mode.

| Question | What to check next |
|---|---|
| Are you filing a plaint, appeal, application or another document? | Start with the schedule/category applicable to that document. |
| Does the fee depend on the value of the relief? | Confirm the statutory valuation method and Haryana amendment before calculating. |
| Are multiple reliefs claimed? | Check whether the Act requires separate or combined treatment rather than assuming one fee covers all reliefs. |
| Is the filing electronic? | Confirm the current e-Filing payment workflow and the Haryana treasury/court-fee integration presented by the official portal. |
| Is the payment for summons/service, inspection or copying? | Use the separate process-fee, inspection or copying rules rather than the institution fee framework. |
Can court fees be paid online?
The national e-Filing platform states that its filing system supports online payment of court fee and integrates the respective State treasury payment gateway where available. The platform is used for civil and criminal filings before High Courts and District Courts and supports filing of plaints, written statements, replies and applications.
For a Gurgaon District Court filing, the practical rule is to use only the payment option presented by the current official filing workflow for the selected court and case type. A payment method available for one court complex, filing category or State integration should not be assumed to apply universally.
Court fee and process fee are not interchangeable
Punjab & Haryana High Court Rules and Orders, Volume IV separately lists a chapter on court fees and stamps and another chapter on process fees. This separation matters. Court fee may relate to institution or the document itself, while process fee may relate to issuing or serving summons, notices or other court process.
When a filing screen or registry objection refers to a deficient amount, identify which charge is actually deficient. Paying additional process fee will not necessarily cure deficient court fee, and vice versa.
Can court fee be refunded or remitted?
The High Court's Volume IV includes rules dealing with reduction, remission and refund of court fee. Whether a refund is available depends on the statutory or rule-based ground and the procedural circumstances. A user should not assume that withdrawal, settlement, rejection, return of plaint or other termination automatically produces the same refund consequence.
Where a refund question is material, verify the exact Court-Fees Act provision, applicable State amendment and current court procedure before taking action.
What happens if the Gurgaon filing has deficient court fee?
A court-fee deficiency can become a scrutiny objection. The correct response depends on why the fee is considered deficient. The problem may be a simple payment or upload issue, but it may also arise from disagreement over valuation, relief classification or the applicable statutory entry.
Use the Gurgaon Filing Objections guide to separate clerical re-filing defects from issues requiring a legal valuation or maintainability assessment. Keep the payment receipt, transaction reference and any electronic acknowledgement with the filing record.
